WHO ARE WE?
We are Amity workers, parents, grandparents, sisters,
brothers, community members, and organizations standing
together with caregivers in their struggle for justice and an
end to the criminal act of wage theft at their workplace.

We struggle so hard to earn money so that
our family can survive daily, meanwhile the
money that we worked so hard for, Nancy
spends them all for her own luxuries. She
does this instead of paying us workers on
time and right amount. We deserve to get
the right wages at the right time that we are
owed from our labor.
WHAT’S THE ISSUE?
Filipino caregivers from Amity In-Home Care Services Inc. have
come forward to reveal that their employer CEO Nancy Reyes
is committing wage theft against her employees. The workers
demand to be paid ON TIME for ALL hours worked!
Some workers expressed not being paid for over 1 month and struggling to afford their basic
needs like rent, food, gas, and healthcare. In one instance, a caregiver was unable to afford
much needed medication for their wife battling cancer.
Many workers reported receiving late checks or
getting little notes instructing them not to cash in
their checks. Workers are often forced to shoulder
expensive bank fees for the bounced checks.

WHAT IS
WAGE THEFT?
WAGE THEFT IS A CRIME!
Wage theft is the withholding of wages or benefits that a worker is legally entitled to such as rest breaks, meal breaks, sick leave, and overtime pay (1.5x) if you work more than 8 or 9 hours in a day. Regardless of immigration status, all workers have rights!
WAGE THEFT: Forcing caregivers to create a “fictitious/fake business name” for 1099 Tax Forms
This “misclassification” of an employee as an independent contractor means that an employer
may avoid paying benefits and wage taxes on behalf of their employee to save money. Yet they
expect caregivers to operate like employees and discourage them from working other jobs.

What’s
been done?
In 2022, Amity workers wrote a letter to the CEO
Nancy Reyes to make their demands clear to be
paid on time and for all their hours worked.
Instead of responding to the workers’ demands,
Nancy responded with petty excuses.
One month later, the workers wrote a second
letter reminding Nancy to respond and to follow
CA labor laws. Yet, Nancy refused to respond to
the workers’ demands.
Instead, Nancy threw an extravagant party to
launch a brand new business, “Amity Forwarders”
in the same year!
Amity workers have moved forward with filing
individual wage claims and some are owed
anywhere from $50,000 to $300,000 in
unpaid wages and penalties.

Now, many community organizations and even Amity clients are on the
side of the caregivers fighting for justice and hundreds have signed
onto a community letter pledging their support for the campaign!
Nancy Reyes is the founder, President, and CEO of Amity In-Home Care Services.
For years, Amity workers have come forward claiming she regularly delays paychecks and issues bounced checks to her workers. When questioned, she allegedly harasses and threatens her workers for simply asking for the paycheck they've worked hard for.
While the main company she owns is Amity In-Home Care Services Inc., she has also owned six other companies (LLCs) and employs hundreds of workers across the state of California.
Who is CEO Nancy?
She supposedly owns at least three
other properties, even placing them
under the names of her ex-husband,
children, or other family members.
Nancy claims the workers should be
"grateful.” In reality, workers are tired of
her excuses and intimidation.
While she is throwing big lavish parties
with Filipino celebrities and traveling
to the Philippines, Amity caregivers are
left stressed and struggling to make
ends meet to support their families.

- Amity Care Peninsula Inc.
- Amity Wellness & Beauty Spa, Inc.
- Amity Care Services, Inc.
- Amity Forwarding Business
- Immediately pay the $2.3 million BOFE citation
- Immediately pay all workers overtime pay as required by California Law
- Immediately pay all workers back wages owed
- Immediately stop the practice of issuing unfunded checks
- Immediately stop the practice of asking workers to delay deposit of their paychecks
- Immediately stop the practice of requiring workers to file for Fictitious Business Names

OUR DEMANDS
- Release Assistance to Nationals (ATN) for Amity Workers
- Release a public statement immediately this month to condemn Nancy Reyes and Amity In-Home Care Services, and similar employers that are taking advantage of Filipino workers and violating their rights. It is urgent that you publicly warn Filipino workers not to work for them or other businesses known to mistreat workers
- Investigate Nancy Reyes assets in the Philippines
- Have a dialogue with Amity workers and Migrante South Bay and discuss what they will do to ensure this does not happen to other workers

Here’s a list of cities of LA County (only for unincorporated areas)
- Overtime Pay: If you are a caregiver hired by an agency, you are entitled to 1.5 X your
hourly rate of pay: (more info here)- after 9 hours in a day
- after 40 hours in a week
- Healthy Workplace, Health Families Act - Starting on January 1, 2024, employers
must generally provide 5 days or 40 hours of paid sick leave to their employees in CA

- Only workers classified as employees are protected under California’s wage and
hour laws, covered by workers’ compensation, entitled to unemployment, and
protected from harassment and retaliation. - Just because your employer gives you a 1099 or pays you under the table does
not mean you are an independent contractor. - It does not matter what your immigration status is. Whether or not you have
papers to work or are paid in cash, you have rights as an employee.
- Only workers classified as employees are protected under California’s wage and
- Retaliation occurs when an employer takes actions such as firing a worker or
reducing hours or pay because the worker took steps to enforce his or her labor
rights.- Your employer is PROHIBITED from retaliating or discriminating against you (for
example, fire, threaten to fire, cut your hours, demote, suspend, or discipline you)
because you complain or provide information to the County of Los Angeles
Department of Public Health, any other County departments or designees, non-
County agencies or entities about workplace violations of public health laws,
rules and regulations. - If your employer discriminates or retaliates against you in any manner (ex: by
firing you or giving you fewer hours), you can file a discrimination/retaliation
complaint with the Labor Commissioner's Office. Alternatively, you can file a
lawsuit against your employer in court.
